B. YOUR POSSIBLE RIGHT TO RETURN YOUR PURCHASE
C. THE NON-LIABILITY AND NON-RESPONSIBILITY OF THE SELLER REGARDING THE USE OF YOUR PURCHASE
These Terms & Conditions do not replace any applicable eBay rules but they take precedence in regard to shipping, import, liability when flying a drone, and return of your purchase.
A. Shipping and Import - Responsibilities of Buyer and Seller
A1. When your delivery address is outside of Switzerland or Liechtenstein.
By placing your order, you agree with the following regarding the import of the listed items into the country of your delivery address.
The seller is responsible for packaging your item properly, creating shipment documentation by means of an Air Waybill, a Packing List, an Export Announcement and a Commercial Invoice, all as much as required by law, adding the Harmonized HS Code of the World Customs Organization to the shipment s documentation, arranging shipping insurance if agreed so with the buyer, informing the shipping company if lithium batteries are included in the shipment, passing the amount you paid for shipping service on to the shipping company, having the shipment collected for export, and sharing the shipment s tracking number with you as soon as the shipment is handed over to the shipping company.
As the buyer of the item(s) in the eBay listing from where you were linked to this document, you are responsible for providing an address where your purchase can be delivered. You are also responsible for the fulfilment of all customs procedures, for obtaining import documentation and an import license if the country of the delivery address requires so, and for payment of any import related charges, duties or taxes that relate to your purchase and the import of it, such as but not only VAT or sales tax, as levied by the country of your delivery address.
Before you order, make sure that you are informed about import procedures, and that you are allowed to import your purchase into the country of your delivery address.
The seller is not responsible for payment of any import charges, duties, taxes or fees, if any, that are associated with importing the items or the shipment into the country of your delivery address.
The seller is not responsible for any shipping delays caused by import or by customs procedures or other circumstances or happenings during shipping. The seller is not responsible either for confiscation, disposal or destruction of your purchase by any customs office. These are explicitely no reasons for you as the buyer to request a (partial) refund of the price you paid to the seller.
A2. Items that the shipping company returns to sender.
The seller is not responsible when the shipping company decides to return your purchase to the sender for reasons such as the buyer having failed to arrange import, or the buyer refused to pay any charges related to import, or because the purchase could not be delivered to the address the buyer has provided on the eBay platform.
If the return shipment is delivered to the seller within 30 days after it was originally shipped to you, and the purchase and its packaging are in the same condition as they were sold to you, you may apply for a refund by sending a message to the seller via eBay messaging. The refund will be equal to the original purchase price minus original shipping costs and minus 15% eBay charges and minus the cost of the return shipment including any customs charges, duties or levies.
If the return shipment is delivered to the seller more than 30 days after it was originally shipped to you, you are not eligible for any refund and in that case you lose your purchase. You have the possibility to open a case with eBay so they can investigate and make a final decision. However eBay has been informed about these terms and conditions.

Contact your local customs office, and contact the shipping company s office in the country of your delivery address as soon as you have received the shipment s tracking number from the seller.
B. LIABILITY OF THE BUYER AND NON-LIABILITY OF THE SELLER
B1. Liability
Our products are often used (“second hand”), but sold as functional. If you have nonetheless received an item in a non-functional or partly-functional state, you have the right to return it within 30 days after the date you purchased it.
HOWEVER, the seller is not liable and not responsible for:
Any damage caused by batteries to your drone, any damage caused by failing batteries during flight, and subsequently any damage caused by the drone that was powered by the batteries you purchased, in particular but not only when your drone crashes as a result of failing batteries, or any other damage caused by flying your drone with our batteries. The proper functionality of flight batteries has to be confirmed by a qualified pilot every time before using them in flight, see also the next paragraph.
Battery reliability is a function of maintenance, technical care, temperature, battery management, charging technology, compatibility with the drone, and many more factors that are completely outside of the control of the seller. Therefore, the seller is not responsible or liable in any form or kind in case of failing batteries during flight.
B2. The fitness to fly of any batteries you have purchased.
You, or if you are not qualified, a qualified drone operator or pilot, are obliged to inspect the batteries you have purchased immediately upon delivery. The decision to fly or not to fly with the batteries you have purchased is solely your responsibility. If the batteries are deemed not functional or if they are damaged other than cosmetic wear from normal use* then you should inform the seller immediately, so the return of your batteries can be arranged.
Do not attempt to fly with batteries that you consider not fit for flying. When in doubt, do not fly. Instead, contact the battery manufacturer to get expert advice regarding the state of your batteries.
B3. Damage caused by flying any drone or a drone with any accessory you have purchased from the seller.
The seller is not liable in case of collisions of the drone, crashing of the drone, the drone failing to fly or to continue flying, damage to the drone itself, water damage to the drone, or any other damage caused by using the drone regardless of the skills, the license or the permits of the pilot. The seller is not responsible and not liable for any consequences of the use of the product sold to you. In most countries, liability insurance that covers the operations of drones is compulsory. It is highly advisable to inform yourself in regard to this before flying your drone or your drone accessory for the first time.
C. RETURNS
Use eBay Messaging to ask the seller for details of the item before you decide to purchase it! Better to ask a lot of questions than to receive an item you do not like.
C1. You may have the right to return your purchase
If the eBay listing of the item you have purchased states the item may be returned, then you may return your item within 30 days after the delivery date, but only if the item is non-functional, and only if the return has been agreed upfront with the seller.
C2. No reason for return
- Wear from normal use* is not a reason to return the item
- Having changed your mind about your purchase is not a reason to return the item
- different than described is not a reason for return. All items are photographed carefully and each listing includes a this is what you buy list of items.
- Being charged import taxes or duties is not a reason to return the item
C3. How to initiate and complete a return
Inspect your purchase immediately after delivery, and contact the seller if you think something is not functional.
To return, contact the seller on eBay Messaging and request the return. The seller will first work with you to see if the non-functionality of your item can be solved. If it cannot, and your purchase is eligible for return, the seller will agree with the return and you can proceed by filing a return request on eBay.
As the buyer of the product, you pay the postage of the return shipment and you are responsible for the delivery of the return shipment at the return address of the seller. Only after delivery of your return shipment, you receive the refund for your purchase.
If your return contains batteries, either separate or built-in to a device, you have to make sure that you are permitted to ship these or your return shipment may be delayed or confiscated or destroyed by authorities. In such cases you will not receive any refund.
On the customs papers that accompany your return, you clearly indicate the shipment is a return. As the incoterm for your return shipment you have to choose “DDP” or your return will not be further processed by the seller and you may lose your purchase. Ask the seller for help if in doubt! If you do not fill out the customs paperwork correctly, you risk that import duties and / or import tax will be charged to the seller, and such charges will be deducted in full from the amount refunded to you.
Once the seller has received your return shipment, it will be inspected and the seller will contact you to either agree on a refund or an exchange of your purchase. When you and the seller agree on a refund, the refunded amount will be credited to the payment method you used when you purchased the item.
*wear from normal use includes scratches, small dents, stains, worn surface coatings, faded labels, discoloration due to sunshine or other influences, and so on. As much as possible, the seller will publish photos in his listings to illustrate the signs of normal wear.
