2. INTRODUCTION AND LEGAL BASIS These Terms govern the sale of goods by ENERGISE & MORE LTD ( we or us ) to you ( Buyer ). By completing a purchase, the Buyer agrees to be legally bound by these Terms. 2.1 Governing Law: This Agreement and all orders issued hereunder shall be governed by and construed in accordance with the laws of England and Wales. 2.2 B2C (Consumer) Sales: Transactions for personal use are governed by the Consumer Rights Act 2015 (CRA) and the Consumer Contracts Regulations 2013 (CCR), which provide statutory cancellation rights. 2.3 B2B (Business) Sales: Transactions for commercial purposes are governed by the Sale of Goods Act 1979 (SGA). For B2B sales, general eBay terms that rely on consumer law (such as automatic, unconditional returns) do not apply, and the stricter terms set forth in Section 5 shall take precedence. 2.4 Precedence and Reservation of Rights: Where any term in this document conflicts with the standard eBay Money Back Guarantee (MBG) policy, we will comply with the MBG policy for the purposes of platform dispute resolution. However, the Buyer acknowledges that such compliance is administrative only and does not constitute a waiver of our legal rights. We explicitly reserve the right to pursue the Business Buyer through the UK Courts for the recovery of any funds refunded by eBay where such a refund contradicts the B2B terms agreed to herein (specifically, but not limited to, the transfer of Risk of Loss under Clause 6.3).
3. BUYER COMMUNICATION AND SERVICE We are committed to resolving issues quickly and fairly. The Buyer must contact us immediately regarding any questions or issues with compatibility, condition, or delivery, or if they believe there is a problem with the item, before opening an eBay case or leaving feedback. We will respond promptly and strive to resolve the matter.
4. SECTION A: RETURNS FOR PRIVATE CONSUMERS (B2C) All sales are assumed to be Business-to-Consumer (B2C) unless the Buyer explicitly notifies us otherwise (see Section 5). B2C purchases are protected by UK Consumer Law. 4.1 Right to Cancel (30 Days): Returns are accepted within 30 days of delivery. The Buyer must request the return through eBay and select the correct remorse reason. 4.2 Return Shipping Cost: The Buyer is responsible for return postage costs if the return reason is Change of Mind, Ordered Incorrectly, or Incompatibility. We will refund the original standard shipping cost. 4.3 Condition Deduction: If the item is returned used, damaged, or handled beyond what is necessary to inspect it (devalued), we reserve the right to deduct a reasonable amount (up to 50% of the item s value) from the refund. 4.4 Faulty/INAD Returns: If the item is genuinely defective or not as described (and not listed as For parts or not working ), we will cover the return postage cost.
5. SECTION B: TERMS FOR BUSINESS BUYERS (B2B) This section applies if the Buyer is purchasing the item for trade, resale, or on behalf of a company (Business-to-Business). 5.1 Acceptance of Terms: By placing an order, accepting delivery, or making any payment for the Products, the Buyer explicitly agrees that these B2B terms form the sole and complete agreement regarding the purchase. General, B2C-oriented terms displayed elsewhere on the eBay platform do not override this B2B contract. 5.2 B2B Assumption: A transaction will automatically be assumed to be B2B if the order volume is clearly for commercial purposes (e.g., bulk purchasing two or more of this item, or a total order value over £100). 5.3 B2C Declaration Required: If a Buyer meets the B2B assumption criteria but requires consumer rights, they must explicitly notify us via an eBay Message linked to the transaction at the time of purchase, stating they are purchasing as a private individual (B2C).
6. NON-NEGOTIABLE B2B TERMS (FINAL SALE AND RISK OF LOSS) 6.1 Final Sale and Returns: The UK Consumer Contracts Regulations DO NOT APPLY to B2B transactions. Products may not be returned to us other than those determined to be Defective On Arrival (DOA). Returns for change of mind, incompatibility, or over-ordering are not accepted. 6.2 Spares or Repair (SGA Exclusion): If the item is listed in the Condition field as For parts or not working, the Buyer accepts the item is faulty and not fit for its normal purpose. The Buyer explicitly waives all implied terms of quality or fitness for purpose under the Sale of Goods Act 1979. Returns are not accepted on the basis of a lack of functionality for these items. 6.3 Risk of Loss Transfer (Shipping Liability): THE BUYER ASSUMES THE ENTIRE RISK FOR LOSS, DAMAGE, OR DELAY UPON DISPATCH. Our obligation for insuring the goods ends when the Product is delivered to the carrier for shipment to the Buyer. The Buyer is responsible for pursuing all claims with the carrier.
7. LIMITATION OF LIABILITY (FOR B2B BUYERS ONLY) 7.1 Exclusion of Consequential Damages: UNDER NO CIRCUMSTANCES are we liable for any of the following even if informed of their possibility: loss of profits, loss of business, loss of revenue, or any special, incidental, indirect, punitive, or consequential damages. 7.2 Liability Cap: Our total liability for any actual direct damages suffered by a B2B Buyer is strictly limited to THE AMOUNT THE BUYER PAID FOR THE PRODUCT that is the subject of the claim.
8. WARRANTY AND COMPATIBILITY 8.1 Warranty Limitation: This item is sold with the benefit of any remaining manufacturer s warranty only, unless explicitly stated otherwise in the listing description. WE PROVIDE NO SELLER WARRANTY. 8.2 Compatibility Responsibility: The customer is solely responsible for ensuring the compatibility of the purchased item (including drivers and software) with their own existing equipment. WE ACCEPT NO LIABILITY FOR INCOMPATIBILITY. 8.3 Condition and Verification: All items are sold as described. We record item serial numbers and condition prior to dispatch for all electronics.
9. POSTAGE AND DELIVERY POLICY 9.1 Dispatch Schedule: We operate a 2:00 PM GMT cut-off time for dispatch (Mon-Fri). Orders paid for before 2:00 PM will be dispatched on the same working day. Weekend orders are dispatched Monday. 9.2 Courier Choice: We reserve the right to select the most appropriate courier for your order, guaranteeing any substituted service will be of an equivalent or superior service level in terms of delivery speed and tracking. 9.3 Lost Parcel Timeframe (B2C): For consumer sales, we must wait 10 working days (UK) or 20 working days (International) from the due date before deeming a parcel lost and processing a refund. 9.4 Lost Parcel Timeframe (B2B): Due to the transfer of risk upon dispatch (see Clause 6.3), the B2B Buyer is responsible for initiating and managing any claim with the courier for lost or delayed shipments. We will not voluntarily issue refunds for items lost in transit. We will supply all necessary dispatch documentation (tracking, consignment notes) to facilitate the Buyer s claim.
10. GENERAL TERMS (APPLIES TO ALL BUYERS) 10.1 Refund Condition: Items must be returned in the same condition as received with all original packaging and accessories. Refunds are issued once the item is received and inspected. 10.2 Fraud Protection: Returned units must exactly match the unit originally sent (verified by serial number). Misuse of return options or fraudulent returns will be reported to eBay and relevant authorities. 10.3 Item Condition: The item is sold based on the condition listed in the main eBay Condition field (e.g., Used , or For parts or not working ).
11. FINAL LEGAL TERMS 11.1 Governing Law: This Agreement and all orders issued hereunder shall be governed by the laws of England and Wales. 11.2 Jurisdiction: Both parties agree to submit all disputes relating to this Agreement to the exclusive jurisdiction of the Courts of London, United Kingdom.

1. INTRODUCTION AND LEGAL BASIS This Returns Policy governs the sale and return of goods by ENERGISE & MORE LTD via the eBay platform. It distinguishes between Private Consumers (B2C) and Business Buyers (B2B) in accordance with UK Law. While we comply with eBay’s internal Money Back Guarantee (MBG) regarding the processing of refunds on the platform, this compliance is administrative only and does not waive our legal rights under the B2B contract. Where a refund processed by eBay contradicts the strict B2B terms agreed to by a Business Buyer, specifically regarding risk of loss or restocking fees, we reserve the right to recover those funds or fees via the UK Courts.

Regarding items sold as New and in original sealed packaging, these must be returned in the exact same condition. If the item is returned opened with the factory seal broken, the resale value is significantly reduced; in accordance with eBay s partial refund guidelines for altered items, we will deduct up to 50% from the refund amount.
4. SECTION B: RETURNS FOR BUSINESS BUYERS (B2B) This section applies if the Buyer is purchasing for trade, resale, or on behalf of a company, noting that the UK Consumer Contracts Regulations DO NOT APPLY to B2B transactions. Returns for change of mind, incompatibility, or over-ordering are generally not accepted. If we explicitly agree to accept a discretionary return for a business transaction where not legally required, a restocking fee of 25% applies to cover administrative and handling costs. If eBay s platform enforces a 100% refund in such instances, we reserve the right to invoice the Business Buyer separately for this 25% fee, and failure to pay this invoice will result in debt recovery action. Regarding risk of loss, as per our Terms and Conditions of Sale (Clause 6.3), risk passes to the Business Buyer upon dispatch. If a parcel is lost in transit and eBay forces a refund under the MBG, the Business Buyer remains liable for the cost of the goods, and we reserve the right to pursue recovery of these funds off-platform.
5. ITEMS SOLD FOR PARTS OR NOT WORKING If an item is listed in the Condition field as For parts or not working , the Buyer accepts the item is faulty. Returns are not accepted on the basis of a lack of functionality for these items.
6. PACKAGING GUIDELINES To ensure a full refund, you must follow specific packaging guidelines, and failure to do so may result in a deduction from your refund if the item arrives damaged. You should use original packaging if available, including the box, accessories, labels, and internal packaging. Secure the item by wrapping it in bubble wrap to protect from bumps and scratches. Choose a box that is only slightly larger than the item; if the original box isn t suitable, use a new, sturdy cardboard box. Prevent shifting by filling any empty space with packing paper or bubble wrap. Secure the box by taping the top and bottom securely. Handle liquids with care and ensure they are in a separate bag with caps securely fastened. Finally, attach the return shipping label clearly to the outside of the box and do not write directly on the manufacturer s packaging.
7. GENERAL RETURN CONDITIONS AND LIABILITY Items must be returned in the same condition as received with all original packaging and accessories. The Buyer bears the risk for the return shipment until it is successfully delivered to us; if the return item is lost, no refund will be issued, and it is the sender s responsibility to organize compensation with their chosen courier. Any damage incurred during the return journey due to poor packaging is the responsibility of the Buyer, and we will deduct the devaluation amount from the refund. We record serial numbers prior to dispatch, and returned units must exactly match the unit originally sent. Misuse of return options or fraudulent returns, such as returning a different unit, will be reported to eBay and relevant legal authorities.
