In der aktuellen Auflage der Insolvenzordnung (InsO), welche zum 01.01.1999 in Kraft getreten ist, ist durch 1 InsO das oberste Verfahrensziel, die Glaubiger gemeinschaftlich zu befriedigen. Mit der Neueinfuhrung dieser InsO wird jedoch auch erkennbar, dass der Gesetzgeber nun auch die Sanierung notleidender Unternehmen vorsieht, anstatt diese zu liquidieren. Es sollte ein Grundstein fur den Erhalt der Unternehmen gelegt werden, damit sie wieder wettbewerbsfahig werden bzw. es weiterhin bleiben. Als Vorbild galt das erfolgsversprechende amerikanische Insolvenzrecht nach Chapter 11, da die dortigen Sanierungen sehr erfolgreich verlaufen und eine zweite Chance fur ein Unternehmen als ein gangiges Verfahren angesehen wird. Allerdings konnte dieser Erfolg nach Deutschland nicht ubertragen werden, sodass wieder ein Handlungsbedarf seitens des Gesetzgebers geboten war. Es folgte die Einfuhrung des Gesetzes zur weiteren Erleichterung der Sanierung von Unternehmen (ESUG) und mit ihr neue Instrumente, die mit ihrer Umsetzung in der Praxis zu einer neuen Insolvenzkultur in Deutschland fuhren sollten.
