Terms & Conditions
These Terms and Conditions together with the documents referred to in them tell you the basis on which we will supply to you our goods (“Goods/Product(s)”). Please read these terms carefully before ordering any Goods from us. By ordering any of the Goods, you agree to be bound by these terms. You should retain a copy of these terms for future reference.
If for any reason you are dissatisfied with any aspect of our service please do not hesitate to contact us.
 
INFORMATION ABOUT US
1. The Goods are provided by Brake Stop (Brake Stop Ltd.) ("we/us/our").
2. We can be contacted via email Brakestopltd@yahoo.com in relation to the application of these Terms and Conditions.
3. We trade utilising the EBAY online business platform and comply with all their regulations.
 
YOUR STATUS
4. By placing an order with us, you warrant that: you are legally capable of entering into binding contracts;
5. You are at least 18 years old;
6. The information you provide to us during the process of placing an order for Goods is accurate, complete and not misleading.
 
APPLICATION
7. These terms and conditions apply to all sales of Goods provided by us to you.
8. If you are purchasing Goods, no contract for the supply of Goods (“Contract”) will come into existence until we dispatch the Goods and/or send you notification confirming that your Goods have been dispatched (whichever is the earlier).
9. If you purchase Goods by any means other than via EBAY, the Contract will not come into existence until either your order (however given) is accepted by the earliest of our written acknowledgement of order and/or delivery of the Goods.
10. Each order for Goods by you to us will be deemed to be an offer by you to purchase Goods subject to these terms. Each order placed by you to us for Goods and accepted by us will constitute a separate contract.
11. You must ensure that the terms of your order and any applicable specification are complete and accurate.
12. These Terms and Conditions will be incorporated in the Contract to the exclusion of all other terms and conditions. They supersede all prior dealings, negotiations, representations or agreements between us in respect of the subject-matter of the Contract whether written or oral.
13. We reserve the right to deliver Goods of a modified design as specified by the original manufacturer provided that any difference does not make the Goods unsuitable for any purpose you have made known to us.
14. Technical specifications are the original manufacturers unless specifically stated otherwise.
15. You will not remove, alter, deface, obfuscate or tamper with any of the trade marks, names or numbers affixed to or marked on the Goods nor allow anyone else to do so.
 
CONSUMER RIGHTS
16. Our Terms and Conditions do not affect your statutory rights.
17. This Contract will be governed by English law and you consent to the non-exclusive jurisdiction of the English courts in all matters regarding it.
 
PRICES
18. The prices of the Goods will be as quoted in our marketing literature from time to time except in cases of obvious error. The prices may be altered at any time without notification to take into account any increase in our costs (including but not limited to the cost of materials, labour, transport or other overheads, any tax, duty or variation in exchange rates).
19. The prices that you pay for the Goods will be those ruling (in the case of Goods) at the date of dispatch of the Goods. This clause will not apply to orders placed by you which have been acknowledged in writing by us in which case the prices quoted on the acknowledgement will apply.
20. Our prices will list where VAT is applicable. All prices are exclusive of any other sales tax or duty that may be applicable which will be payable in addition to the price unless otherwise stated.
21. You acknowledge that we stock a large number of Goods. It is always possible that, despite our best efforts, some prices may be incorrectly listed. We are under no obligation to provide Goods to you at an incorrect, lower price, even after we have acknowledged your order or dispatched the Goods, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as mis-pricing.
 
PAYMENT
22. All goods must be paid for in full prior to dispatch.
23. Payments by credit or debit card will be accepted where the card in question has been verified on our website or by telephone order.
24. We reserve the right to charge a credit card surcharge if you elect to pay us by credit card.

DELIVERY
25. The Goods will be despatched only on receipt of full payment for the goods.
26. All goods are sent primarily via Royal Mail first class post. This applies only to UK mainland excluding Highlands and Islands and excludes Sat/Sun. All other destinations will be agreed with us in advance. We will use all reasonable endeavours to avoid late deliveries.
27. We reserve the right to utilise alternative postage/courier methods in the event of a reduced or delayed Royal Mail service.
28. The quantity of any consignment of Goods as recorded by us upon dispatch from our place of business will be conclusive evidence of the quantity received by you on delivery unless you can provide conclusive evidence proving the contrary.
29. We will not be liable for any non-delivery of Goods unless written notice is given to us and Royal Mail or an alternative courier substantiate non-delivery.
30. Our liability for non-delivery of the Goods will be limited to replacing the Goods within a reasonable time.
31. Any claim that any Goods have been delivered damaged or do not materially comply with their description will be notified by you to us at the time of delivery.
32. If you fail to take delivery of the Goods then we will be entitled to cancel or suspend such delivery and all other outstanding deliveries and to charge you for the loss suffered.
 
RISK AND TITLE
33. Passing of title in the Goods will remain with us and will not pass to you until the amount due under the invoice for them has been paid in full and the Goods have been dispatched to you.
34. Risk in the Goods passes when they are delivered to you. We do not accept any responsibility for the fitting of the Brake Caliper Repair Kits. In the interests of safety therefore, we would recommend you consult the relevant technical guidance relevant to the vehicle. Alternatively, please arrange for a suitably qualified company to complete the work for you.
35. You must double check that the product listed is suitable for your vehicle and also, the person(s) fitting or mechanic must check that the goods supplied by us is an exact match for the vehicle. If you are unsure please contact us for advice. We do not cover any labour costs.
 
REFUNDS POLICY
36. You have 14 days to request a refund on receipt of the Goods. In this case we will refund the price of the Goods to be returned in full, excluding the cost of sending the Goods to you. However, postage costs are non-refundable, so you will be responsible for the cost of returning the Goods to us.
36.1. You have 14 days from the date of requesting a refund to return the Goods to us.
36.2. We will arrange a refund within 14 days of receiving the Goods back.
37. Dirty, damaged and incomplete items will not be refunded.
38. We cannot accept for return any Goods (whether complete or part components) that have been fitted.
39. We will elect to choose the method of refund and this will not necessarily be the same method originally used by you to pay for your purchase.
 
LIMITATION OF LIABILITY
40. Our products are sourced from manufacturers which comply with ISO 9001 and ISO/TS 16949 standards.
40.1.ISO 9001 is the international standard that specifies requirements for a quality management system (QMS). Organizations use the standard to demonstrate the ability to consistently provide products and services that meet customer and regulatory requirements.
40.2. The ISO/TS16949 is an ISO technical specification aimed at the development of a quality management system that provides for continual improvement, emphasizing defect prevention and the reduction of variation and waste in the automotive industry supply chain.
41. We have full a Commercial Insurance Policy covering Public and Product Liability. Limit of Liability: Public (£2000,000) and Product (£2000,000).
42. Any liability is subject to complying with these Terms and Conditions in particular sections 34 & 35.
 
TERMINATION AND SUSPENSION
43. We may at our discretion suspend or terminate the supply of any Goods in the event that business processes prevent us complying with the Contract. In this case a full refund will be given.
44. Orders accepted by us are cancellable only at our discretion and we may charge for all work carried out or expenses incurred in relation to the order before our acceptance of cancellation.
 
FORCE MAJEURE
45. We will not be liable for any failure in the performance of any of our obligations under the Contract caused by factors outside our control.
 
GENERAL
46. Each of our rights or remedies under the Contract is without prejudice to any other right or remedy that we may have whether under the Contract or not.
47. If any provision of the Contract is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable it will to the extent of such illegality, invalidity, voidness, voidability, unenforceability or unreasonableness be deemed severable and the remaining provisions of the Contract and the remainder of such provision will continue in full force and effect.
48. Failure or delay by us in enforcing or partially enforcing any provision of the Contract will not be construed as a waiver of any of our rights under the Contract.
49. Any waiver by us of any breach of, or any default under, any provision of the Contract by you will not be deemed a waiver of any subsequent breach or default and will in no way affect the other terms of the Contract.
50. Neither of us intends that any term of this Contract will be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person that is not a party to it.
